Terms of Service
These Terms of Service govern your use of the Callonica platform and services operated by Troxo Pty Ltd (ABN to be confirmed), Sydney, Australia. By using Callonica you agree to these terms in full.
1. The service
Callonica provides a bespoke AI receptionist service that answers phone calls on behalf of small businesses. The service includes call answering, call transcription and summarisation, appointment booking via Cal.com, post-call email and SMS notifications, and access to a client dashboard.
2. Account and access
Access to your Callonica dashboard is provided via a unique URL and password. You are responsible for keeping your login credentials secure. You must not share your dashboard access with unauthorised parties. You must notify us immediately at support@callonica.com if you suspect unauthorised access.
3. Subscriptions and billing
Callonica is offered on a monthly subscription basis. Pricing is agreed individually for each client prior to setup. Subscriptions are billed monthly via Stripe. By subscribing you authorise Callonica to charge your nominated payment method on a recurring monthly basis until you cancel.
Setup fees are charged once prior to service commencement and are non-refundable once setup has begun.
4. Cancellation
You may cancel your subscription at any time via the Stripe customer portal accessible from your dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
5. Usage limits and overages
Your subscription includes a monthly call minute allowance as agreed at signup. Usage exceeding your allowance will be charged at the overage rate agreed at signup. You will be notified when you are approaching your limit.
6. Acceptable use
You must not use Callonica to:
- Answer calls for illegal, fraudulent, or deceptive purposes
- Impersonate any person or entity in a misleading way
- Violate any applicable law or regulation
- Transmit spam, unsolicited messages, or harmful content
- Interfere with or disrupt the platform or its infrastructure
We reserve the right to suspend or terminate your account immediately if we reasonably believe these terms are being violated.
7. Call recording and transcription
Calls handled by Callonica are recorded and transcribed. You are responsible for ensuring callers are informed that calls may be recorded, in accordance with applicable laws in your jurisdiction. Callonica notifies callers of AI assistance at the start of each call. You must comply with all applicable call recording laws in your state or territory.
8. Intellectual property
All intellectual property in the Callonica platform, including software, design, and content, remains the property of Troxo Pty Ltd. Call transcripts and summaries generated from your calls are provided to you for your business use.
9. Limitation of liability
To the maximum extent permitted by law, Troxo Pty Ltd is not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of Callonica, including missed calls, booking errors, or service interruptions. Our total liability to you in any circumstance is limited to the amount paid by you in the preceding month.
10. Service availability
We aim to provide a reliable service but do not guarantee 100% uptime. Planned maintenance will be communicated in advance where possible. We are not liable for downtime caused by third-party providers including Twilio, Retell AI, or cloud infrastructure providers.
11. Privacy
Your use of Callonica is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.
12. Governing law
These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
13. Changes to these terms
We may update these Terms of Service from time to time. We will notify you of material changes via email with at least 14 days notice. Continued use of Callonica after that period constitutes acceptance of the updated terms.
